where we need to on this is disgusting. >> reporter: president obama said he want taxes and spending cuts at the same time. >> but with this congress that was a little too much to hope for at this time. >> reporter: house speaker john boehner has not publicly endorsed the deal. tara mergener for cbs news, washington. >> now, the house is set to reconvene today at 9 a.m. pacific time. a house vote is expected today or tomorrow. what a night. no fog this year, perfectly clear last night for fireworks along the waterfront here in san francisco. it's beautiful out there. a lot of people showed up for the 15-minute display and jammed the streets near the bob barker. when it was all over, i think most of them are still out there, it was crowded getting into work today but there was some violence during the new year's celebration here in the city. cbs 5 reporter cate caugiran is in san francisco with the

problems police had with the new year's crowd and has the latest. >> reporter: good morning. happy new year. san francisco police had their hands full because some celebrations did not go as planned. there were two separate shootings last night. now three people are recovering from gunshot wounds. the first one happened around 10:40. a victim was shot in the hand near jefferson and mason near fisherman's wharf. the second shooting happened less than an hour later on the embarcadero past peer 23. a 12-year-old boy was shot in the foot and a man suffered a graze wound to the hip. police have not arrested any suspects in either shooting. >> there's a month of design that we do actually working on the computer designing how we want -- when we want the shells to go off, there is a sound track that will be broadcast on the embarcadero. >> as you can hear not all celebrations went wrong. this was great here. aside from those incidents, san francisco still well comedy

2013 with bright lights, about 5,000 fireworks, tens of thousands of partiers coming out to watch the well-lit 15- minute show. police also though aside from that did make a handful of arrests. some people took their parties too far. eight people were arrested for public intoxication and two for misdemeanor. live in san francisco, cate caugiran, cbs 5. two people are dead and through injured after a the shooting in the old sacramento area. about 40,000 people were gathered for a fireworks show when shots rang out on second street. police say there was a fight at a cafe just before the shooting. >> at first when i heard the bullets, everybody was running into the stores to hide and i immediately went out because i wanted to see what the action was. and then i seen the officer jump off has horse. the horse kept going. and the officer just did not

have no fear. he just took that guy down. >> mayor kevin johnson says there's no indication of any outstanding suspects and police canceled a midnight fireworks show because of it. 4:35 now. here's a check of some of the holiday closures here in the bay area. most federal, state, county and city offices closed new years day including the post office and there is no mail delivery today. banks are closed. and here in san francisco, you don't have to feed the meters. >> considering how many people are out they may as well be closed. >> it's crazy. thousands of people have been waiting in the cold down in pasadena as well to secure a good spot -- [ laughter ] >> are you okay? >> that chair is so tricky, frank. [ laughter ] >> -- to watch the rose parade. >> eager fans are staking out front row seats on the sidewalks all along that 5.5- mile parade route. and a lot of them say they have done this before and they know exactly what to bring.

concord. 37 also in san jose and 45 degrees in san francisco. by the afternoon, cool temperatures indeed but lots of sunshine, upper 40s in some parts of the coolest parts of the inland valleys. you will see 50s around the bay area. looks like we'll keep things dry for a while. there is rain in the forecast. we'll talk more about that in a moment. let's talk to gianna for traffic. >> let's head to the bay bridge. you can see traffic is very light towards the toll plaza. no delays to report right now. metering lights are off. should remain off for most of the morning. it's expected to be quiet on the roads. you're clear into san francisco. now, the golden gate bridge, we are seeing yellow on our drive times south 101 but i checked in with chp. not showing any accidents. there's no caltrans work this morning due to the holiday, so looks like the sensors are just updating right now. so far, so good there. 880 looking good, northbound clear towards the maze. southbound 880 looks good towards hayward. travel times in the south bay, no delays along 101, 280 also clear and guadalupe parkway an

easy ride on the northbound side from 85 to 101. we'll get a live look at conditions along 101 in the south bay in a few minutes. back to you. >> thank you. a major dismantling of some marijuana operations in remote areas of santa clara county. sheriff's deputies dangled on a 100-foot rope suspended from a helicopter and dropped into eight separate locations. a little help from the state fish & game wardens, they cleared more than four tons of material including irrigation tubing, gardening equipment and a honda muffler that may have been used on a generator. 4:38 now. contra costa county is operating with four fewer fire stations this morning. contra costa supervisors voted unanimously last month to close four stations in clayton, lafayette, martinez and walnut creek. this move is expected to save the district up to $8 million a year. on january 10, fire officials will meet with martinez residents to talk about the

their closure. in other bay area headlines, a noontime vigil is planned in oakland today for a man who was shot and killed while detained by bart police. family will hold a vigil at the fruitvale bart station. that's where oscar grant was shot four years ago today. officer johannes mehserle was later found guilty of involuntary manslaughter. he was released from prison in june 2011 after serving his sentence. the reward is now up to $15,000. this is for information leading to an arrest in the shooting death of a 15-year-old girl in east oakland. investigators say that jubrille jordan was shot sunday at 66th avenue and lion way as she and a 14-year-old boy were walking to a bart station. the boy was wounded in the foot. an exciting end to 2012 at mineta international airport in san jose. a man hopped a fence and took off across the tarmac. this all happened around 8:00 last night. the man apparently made it

this is surveillance video a store in fort lauderdale saturday. they broke in thieves pull off a heist at a jewelry store. this is surveillance video from a store in fort lauderdale, florida on saturday. they broke in through the roof and then used massive tanks to cut through the safes. they also cut the alarm system and ripped out a camera. they got the contents of three

there. temperature about 32 degrees in lake tahoe. we have a freeze watch in the north bay valleys tonight and the mountains. overnight lows tonight expected to the mid- to upper 20s. cold indeed. well, for today, we have a couple of clouds early on this morning. those should begin to clear out. by the afternoon should become mostly sunny on this first day of 2013. the temperatures are still going to be a bit cool outside. highs ranging in the upper 40s and the low 50s outside. 54 san jose. 51 pacifica. 53 hayward. east bay temperatures in the upper 40s and low 50s. and the for the bay maybe just a little warmer, maybe about 56 degrees in santa rosa and 54 in petaluma. next couple of days we are going to see some dry weather continuing, weak system slides by on thursday to bring more clouds but staying dry. and then looks like your next best chance of ran now comes near the coastline on sunday. but dry into monday. that's a look at weather. let's check traffic with gianna. >> all right, lawrence.

well, traffic is looking pretty good now. no problems. an overview of conditions in the south bay. you can see we're clocking in some pretty fast seeds. so far, so good north 101 no delays. 280 looking good. travel times right now through the south bay, everything is in the green. no delays anywhere. live look at conditions 880/237. one lonely car on the roads. all by itself. cruising along there. it's only going to take six minutes westbound 237880 to 101. a couple of cars heading northbound 880 towards the maze. so far traffic is clear, southbound looking good, as well. no delays to report 880 looks good into hayward and fremont. 101 showing lots of green. if you have an early flight to catch at sfo north 101 not showing any delays all the way through there. in fact, all the way into san francisco traffic looks good.

everything looking good through the altamont pass westbound 580. 14 minutes altamont pass to 680. once you hit 680 they brake lights to report. traffic is clear at the dublin interchange. 680 itself also looking good. now, mass transit is on time. bart though is on a holiday schedule as well as most of mass transit. so make sure you check the websites before you head out. looks like bart won't resume at least for another hour but they did run late trains last night for new year's eve. caltrain, ferries, everything on a holiday or sunday schedule so heads up out the door. >> that one car on the road was probably the last person to leave the party. secretary of state hillary clinton is expected to make a full recovery after she was diagnosed with a blood clot. she is being treated at new york-presbyterian hospital where doctors hope that blood thinners will dissolve the clot. they say it is between her brain and skull right behind her right ear.

>> we know that two to three weeks ago, she fainted and hit her head. at that time, she could have had trauma. she could have ripped that vein and had a little bleeding and clot formation. on top of that, we were told she had a stomach virus and we know that doe hydration increases the odds of having a clot. >> doctors treating secretary clinton say that the clot has not caused a stroke or any kind of neurological damage. they did say that she will be released from the hospital once the medication dosed for the blood thinners has been established. 4:47. there is a sudden surge of marriages in maryland this new year's day. same-sex couples can now legally wed in that state. city halls in baltimore and some of the other industries were open at midnight for couples who didn't want to wait. maryland is the ninth u.s. state where same-sex marriage is now legal. marijuana clubs are starting to pop up in the state of colorado. at least two have opened less than a month after governor john hickenlooper signed into

law a constitutional amendment allowing recreational pot use in the state. one club says 200 people have already signed up, paid the $30 admission fee. they have to bring their own stash. the club's attorney says as long as marijuana is not sold there, it will be legal in that state. america's major stock markets did a lot better in 2012 than they did the year before. now, the dow finished the year with a 7% gain. it added 5.5% in 2011. the nasdaq did better. it rose 16% in 2012. that followed a nearly 2% loss in 2011. the markets are closed today for the new year's holiday. sales tax in california is higher this morning than it was yesterday. the tax increased by .25% because of prop 30 that was passed by voters in november. the initiative, pushed by the governor, increased sales tax rates to 7.5%. that works out to be 1-cent for every four dollars you spend.

>> even if it's one penny, it's five cents, it's going to add up because -- i'm only 21 and i spend money like it's nothing. >> so local governments have even higher taxes and the bay area taxes in el cerrito and union city are now at 9.5%. there are also a number of new laws set to go into effect today. drivers in california can now text and email while driving if they use a voice-operated system. other laws restrict banks from pursuing so-called dual track foreclosures. and there are also several measures designed to ensure the safety of natural gas pipeline. but there's one contested measure that's still on hold a ban on gay conversion therapy. it will not go into effect because of a federal appeals court issuing a stay. chp out in force last night looking for anyone who shouldn't be on the roads and here's a sobering thought. a dui can cost you up to

$7,000. cbs reporter mark strassmann shows how some new technology could put the brakes on drunk driving. reporter: >> so we want to take this device and implement it in the car. >> reporter: bud is leading a team creating technology that might prevent 10,000 drunk driving deaths a year. unlike this existing breathalyzer test for convicted drunk drivers, these two new sensors would test anyone behind the wheel. >> the injured to develop a sensor that can be -- the idea is to develop a sensor that can be able to prevent anybody above the legal limit from moving the vehicle and driving. >> reporter: the touch-based sensor in the start stop button shines an infrared light into the driver's finger. in a half second, it measures the alcohol content in the tissue. the second type of technology is a breath-based sensor mounted near the steering wheel that would measure molecules in a driver's breath. how far away is this technology from being ready? >> eight to 10 years when you

would start seeing it in vehicles. >> reporter: the $10 million funding for his project is split between 16 carmakers and the federal government. but it's opposed by the american beverage institute which represents 8,000 chain restaurants in the u.s. the group made the following statement." drunk driving fatalities are at historically low levels. we shouldn't try to solve what's left of the drunk driving problem by targeting all americans with alcohol sensing technology." mark strassmann, cbs news. a teen finds a stack of cash on the ground. what he did next that police officers were shocked by. >> pass the as spas gas. the asparagus to cure a hangover. >> and we'll go to new york city for the ball drop. ♪ [ music ]

happy new year! weather outside looking good. a couple of clouds. a lot of sunshine. more on that in a few minutes. >> and it's a great way to start new year's day on the roads. traffic very light. no delays to report on the bay area bridges. pleasanton 580 looking good now. traffic and weather together every 10 minutes. the health of the economy could actually influence whether a child picks up unhealthy habits. scientists at the state university of north carolina found children who grew up during times when unemployment rates were high were more likely to drink, smoke or use marijuana in their teens. weigh searchers -- researchers want doctors to deal their studies to include children born in the recession.

if you partied too hard last night you may wan to eat some asparagus. scientists in korea analyzed the vegetable's chemical compounds. they believe the amino acids and minerals in asparagus can replenish the body and aleve yai hangover. the study also found a spas gas can protect the liver from toxins including alcohol. >> i saw a plate of that in the weather department this morning. >> explains a lot. >> okay. [ laughter ] the nation's biggest new year's celebration, of course, one big city. new york. 3, 2, 1! >> about a million people from all over the world got the times square treatment as new york's huge crystal ball dropped national new year. the revelers found it all quite cold but worth it. it's cold. takes a year to get out of there, though.

kissing time at times square at midnight. happy couples celebrating the new year smooched to welcome in 2013. some warm hugs also helped but the chilly weather in new york city -- it just doesn't matter. >> you're going to need those hugs and kisses. it's freezing in new york. >> what's your name? can i hug you? it's cold out here. a lot of people are praising an orange county college student who found $800 and then turned it over to police. >> that's right. 18-year-old gerardo marquez was going out for pizza with some of his friends when he discovered the money in the envelope. he said he and his friends considered briefly keeping the cash. >> then i -- we decided no, let's think this further. >> the money was traced to a nearby cell phone store. apparently the manager dropped that money on the way to the bank. >> it's a wonderful life kind of thing. >> good guy.
